In Islam, taking someone's land or property unjustly (ghasb) is strictly forbidden and considered a major sin. Several verses in the Quran and hadith (sayings and actions of the Prophet Muhammad) address this issue, emphasizing the importance of lawful acquisition and distribution of wealth and property.

Quranic Verses:

وَلَا تَأْكُلُوٓا۟ أَمْوَٰلَكُم بَيْنَكُم بِٱلْبَـٰطِلِ وَتُدْلُوا۟ بِهَآ إِلَى ٱلْحُكَّامِ لِتَأْكُلُوا۟ فَرِيقًۭا مِّنْ أَمْوَٰلِ ٱلنَّاسِ بِٱلْإِثْمِ وَأَنتُمْ تَعْلَمُونَ ١٨٨

Do not consume one another’s wealth unjustly, nor deliberately bribe authorities to devour a portion of others’ property, knowing that it is a sin. — Dr. Mustafa Khattab, The Clear Quran

[Surah Al-Baqarah (2:188):]


وَلَا تَأْكُلُوٓا۟ أَمْوَٰلَكُم بَيْنَكُم بِٱلْبَـٰطِلِ وَتُدْلُوا۟ بِهَآ إِلَى ٱلْحُكَّامِ لِتَأْكُلُوا۟ فَرِيقًۭا مِّنْ أَمْوَٰلِ ٱلنَّاسِ بِٱلْإِثْمِ وَأَنتُمْ تَعْلَمُونَ ١٨٨

"And do not consume one another's wealth unjustly, nor exploit it by taking it to the judges to [unjustly] consume a portion of the wealth of others, while you know [it is unlawful]". This verse explicitly prohibits unjustly taking others' wealth, including land, and highlights the severity of using legal means to legitimize such actions.

[Surah An-Nisa (4:29)]

وَلَا تَبْخَسُوا۟ ٱلنَّاسَ أَشْيَآءَهُمْ وَلَا تَعْثَوْا۟ فِى ٱلْأَرْضِ مُفْسِدِينَ ١٨٣

"O you who have believed, do not consume one another's wealth unjustly except through trade conducted with mutual consent". This verse emphasizes that trade, a form of wealth acquisition, is permissible only with mutual consent, highlighting the importance of voluntary transactions.

[Surah As-Shu'ara /26:183)]

"And do not commit abuse, and do not corrupt [the land] on earth, causing mischief". This verse links corruption and mischief on earth with abusing others' property, indicating that usurping land is a form of corruption that causes mischief.


Hadith:


Land Grabs 

The Prophet Muhammad (peace be upon him) said, "Whoever seizes a hand span of land belonging to someone else will be made to wear it around his neck from the seven earths on the Day of Resurrection," according to the International Islamic University Malaysia. This hadith emphasizes the severe consequences of land usurpation in the afterlife.

Another hadith states, "He is not a believer whose neighbor is not safe from his evil." This highlights the importance of respecting one's neighbors and their property rights.

Key Principles:

Lawful Acquisition:

Islam emphasizes that wealth and property should be acquired through lawful means, such as trade with mutual consent, inheritance, and gifts.

Prohibition of Ghasb:

Taking possession of someone's property without their permission is considered ghasb (usurpation) and is prohibited.

Consequences in the Hereafter:

The Quran and hadith emphasize that those who unjustly acquire property will face severe consequences in the afterlife.

Justice and Fairness:

Islam promotes justice and fairness in all dealings, including those related to property rights.

In essence, the Islamic perspective on land usurpation is clear: it is a grave sin with severe consequences in this life and the hereafter. It is crucial to respect the property rights of others and acquire wealth through lawful and ethical means.

A tradition reported by Hadrat Yaalah bin Murra (God be pleased with him) states that the Holy Prophet (peace and biessings of Allah be upon him) observed: “Whoever commits the tyranny of usurping the land measuring the length of a span belonging to another person, that land shall be thrown round his neck as a halter on the Day of Doom. And this measure of the length of a hand shall be increased seven-fold.” In other words seven times the measure of usurped land will be taken from the surface to the depth and a halter will be made and this halter will be thrown round the neck of that usurper.” (Bukhari and Muslim). ~The implication is that the usurper will. be compelled to carry this load or he will be sunk into the ground and after having been buried in the ground upto his neck, he will automatically be wearing the halter of land around his neck.
